Ivaluna Terms of Use
Effective date: October 14, 2026 Last updated: October 14, 2026
These Terms of Use ("Terms") govern your use of Ivaluna, a baby tracking app provided by [COMPANY NAME] ("Ivaluna", "we", "us", or "our"). By creating an account, signing in, or using Ivaluna, you agree to these Terms and the Ivaluna Privacy Policy. If you do not agree, do not use Ivaluna.
1. What Ivaluna provides
Ivaluna provides tools for caregivers to record and review sleep, feeding, diapers, growth, photos, notes, reminders, caregiver sharing, educational content, reports, and optional assistant features. Features may change, be limited by membership tier, or be unavailable while we maintain the service.
Ivaluna is not a hospital, medical provider, emergency service, telehealth provider, medical-device manufacturer, or professional sleep-consultation replacement.
2. Eligibility and caregiver authority
You must be old enough to enter a binding contract where you live. The person who creates an account must be an adult caregiver or authorized representative and must have the right to provide the information entered about a child. Do not let a child use Ivaluna to create an account or submit personal information.
You are responsible for confirming that every parent, caregiver, viewer, consultant, or other person you invite is authorized to access the child's record. Treat share codes as confidential. You are responsible for activity under your account until you notify us and secure it.
3. Accounts and security
Provide accurate information, keep your email current, and protect your password and device. You may use optional Apple or Google sign-in when it is available. We may suspend access to protect people, the service, or the law if we reasonably suspect fraud, abuse, or unauthorized access.
You may export your visible logs and can request account deletion from Settings. Deletion may remove a child only when you are the last remaining parent; a shared child may remain for another parent. Deletion does not undo information that another caregiver has independently exported or retained.
4. Your content and sharing
You keep ownership of the photos, notes, logs, messages, and other material you submit. You grant us the limited license needed to host, copy, format, calculate, display, synchronize, secure, and provide that content to you and the caregivers you authorize. You also allow the optional assistant providers you actively use to process the limited context described in the Privacy Policy.
Do not upload content that you do not have permission to use, that violates another person's privacy, or that contains unnecessary identifiers. Do not use another caregiver's account, guess a share code, or attempt to access a child record without authorization.
5. Optional assistant, photo logging, and guidance
The built-in and optional AI assistant can be incomplete, wrong, or unavailable. Photo and text quick logging produces a proposal; you must review it before confirming. Never treat an assistant reply or generated log as a diagnosis, prescription, emergency instruction, or professional care. Ivaluna will not intentionally ask the model to infer medication doses, but you remain responsible for checking every proposed entry.
The assistant cannot operate a timer or change a record without the action you confirm in the app. Third-party provider terms apply when an optional provider is enabled.
6. Medical and safety disclaimer
Ivaluna is for tracking, organization, and education only. Sleep predictions, growth percentiles, reminders, reports, plans, and assistant responses are not medical advice, diagnosis, treatment, or a substitute for a pediatrician, doctor, midwife, emergency service, or other qualified professional. Do not use Ivaluna to decide a medication dose, feeding safety, breathing concern, fever, or safe-sleep environment. For urgent symptoms or danger, contact local emergency services or a qualified clinician immediately.
7. Memberships, trials, and App Store purchases
Some features may require Plus or Premium. Prices, products, eligibility, and availability are shown before purchase. Any free trial is for eligible accounts and may be limited to one per account. When a purchase is made through Apple's App Store, Apple is the merchant of record for payment processing. The subscription renews and can be managed or canceled through the Apple ID/App Store subscription settings under Apple's terms. Ivaluna verifies signed Apple transactions to grant access; Ivaluna does not receive your payment-card number.
If a subscription expires or is canceled, your logs remain saved subject to the Privacy Policy, while paid features may become unavailable. Gift codes, if offered, may have their own displayed terms and cannot be redeemed by the original purchaser's account.
8. Acceptable use
You must not:
- use Ivaluna for an emergency, clinical diagnosis, professional recordkeeping, or a purpose for which it is not designed;
- violate a child's, caregiver's, or another person's privacy or rights;
- upload malware, unlawful material, or content that exploits or harms a child;
- reverse engineer, interfere with, overload, scrape, or bypass access controls on Ivaluna or its API;
- impersonate another person or misrepresent caregiver authorization; or
- use the service to train an external model or to build a competing service without written permission.
We may remove content or restrict access when necessary to enforce these Terms, protect users, investigate abuse, or comply with law.
9. Intellectual property
Ivaluna's software, brand, interface, illustrations, text, and original guidance are owned by or licensed to [COMPANY NAME] and are protected by applicable law. These Terms give you a limited, non-exclusive, non-transferable, revocable license to use the service for your personal family-care purposes. No rights are granted except those expressly stated here.
10. Availability and third-party services
We aim to keep Ivaluna available but do not promise uninterrupted, error-free, or permanent access. The service may depend on hosting, internet connectivity, Apple, Google, Anthropic, notification networks, or other providers. Those providers may have separate terms, outages, limits, or privacy practices. We are not responsible for a provider's independent service or for content you receive from it.
11. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IVALUNA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT A LOG, PREDICTION, REMINDER, GROWTH PERCENTILE, PLAN, OR ASSISTANT RESPONSE IS COMPLETE, CORRECT, SAFE, OR SUITABLE FOR YOUR CHILD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY NAME] AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR ACCESS ARISING FROM YOUR USE OF IVALUNA. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM IVALUNA WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO IVALUNA FOR THE RELEVANT SERVICE IN THE PREVIOUS 12 MONTHS OR [LIABILITY CAP]. Nothing in these Terms limits rights or liability that cannot legally be limited, including mandatory consumer, privacy, or personal-injury rights.
12. Indemnity
To the extent permitted by law, you agree to reimburse [COMPANY NAME] for reasonable losses and costs resulting from your unlawful use of Ivaluna, your violation of these Terms, or content you submit without the required rights or authorization. This section does not apply where prohibited by consumer law.
13. Ending use
You can stop using Ivaluna at any time and request deletion as described in the Privacy Policy. We may suspend or end access for a material breach, a security risk, prolonged service closure, or legal requirement. Sections concerning content rights, payment obligations, disclaimers, limits, disputes, and interpretation survive termination where appropriate.
14. Governing law and disputes
Before launch, [COMPANY NAME] must replace this section with the correct governing law, venue, consumer-law exceptions, and dispute process for its business location and the markets it serves. Mandatory rights in the country of your residence are not waived by this section.
15. Changes and contact
We may update these Terms as Ivaluna changes. We will update the effective date and provide notice for material changes. Continued use after the effective date means you accept the updated Terms where permitted by law.
